Apple Claims 'App Store' Is Not a Store for Applications

Apple has been fierce at defending their "app store" and "appstore" trademarks this latest position however has me scratching my head. According to Apple the term "app store" does not mean a store for applications. HUH?

According to legal documents filed with a California district court "Apple denies that, based on their common meaning, the words 'app store' together denote a store for apps."

"Apple denies that the words 'app store' are commonly used among many businesses to describe mobile software download services and further denies that the term 'app store market' is used to describe the market for mobile software download services," Amazon and Apple do not operate an "app store," Apple argues.

Now I think I've heard it all. An application store is not a place to buy and download applications? If its not then what is it?
